Defiant Malema to appeal verdict

Suspended ANC Youth League president Julius Malema says he will appeal the ANC's disciplinary committee decision to remove him from the helm of the league.

Malema has spoken to the media outside the UNISA campus in Polokwane where he was sitting for an examination. Malema - who's also been suspended from both the ANC and the Youth League for five years - was given 14 days to appeal the verdict.

He says he is not worried about the decision. "I know that I have been found guilty and suspended for five years, a decision that I'm going to appeal. We are not intimidated by any outcome, we remain resolute and we will continue to fight moving forward. So when you suspend us from the ANC, you are throwing us out of our own homes and that cannot be left unchallenged," says Malema.

He says he will never apologise for his beliefs and those of the Youth League. "Let the enemy enjoy, but that victory will not last. We will be liberated by Mangaung 2012, the real leaders of the ANC must now stand up in defence of the ANC. What I like about these people who have suspended us is that they are brave, they are not scared. We must also fight for what we believe in, we will never apologise, the gloves are off."

The League's spokesperson Floyd Shivambu has also been slapped with a three-year suspension and told to vacate his position after being found guilty, among other things, of using vulgar language against a journalist. However, the chairperson of the ANC National Disciplinary Committee, Derek Hanekom, says Shivambu remains a member of the ruling party.

The ANC Youth League has said it will convene an urgent meeting of its National Executive Committee this weekend to consider the implications of the verdict and map a way forward. The League says while it will respect the internal processes of the ANC, it's unhappy that the disciplinary committee has meted out sanctions without affording the charged members their fundamental right to present mitigating circumstances. They believe this presents grounds for an appeal.

Political analyst Adam Habbib says this debacle is going to continue for a couple of months and it is likely to influence the Mangaung presidential succession race but doubt that it will have a dramatic impact. Another political analyst, Ralph Mathekga, says Malema's punishment is harsher than many had anticipated. Mathekga says he was anticipating a moderate kind of a judgment which is not too harsh, but still demonstrates that the ANC is the leader.

"But when I look at the sanction and also the context and the nature of the charges you can see that the disciplinary committee just wanted to close this once and for all. I don't know whether that will be well received by the parties. I don't know what's going to happen from now. I think its a very severe punishment", says Mathekga.

Meanwhile, the rand has firmed slightly against the US dollar after the verdict against Malema and his colleagues was announced. Malema has been advocating for populist policies such as seizing land from white commercial farmers and nationalising mines, which unnerved foreign investors. The rand was trading at R8 against the dollar before Malema's verdict was announced, but has improved by a quarter of a percent. South African stocks have also improved.

I think ANCYL organisation can be ruled in accordance with the effective n efficient provided they apoint academic young leader who will put action into plan n adhere with the code of conduct of the mother-body so that they may not violate the ithics of the organization, this may play a majar role in the effective of the powerful leadership as youth are regarded as the engen of country's nation

Not everything Malema was saying was bad. He indeed made good points such as youth empowerments. We need people like him to change our nation and the way we think. Its high time the country recognise youth and education and allow the industries to see the potential in youth.
